Rezial Career Center is on a mission to help employers recruit, train, and develop the best employees for their organisations at any time anywhere in the world. We have collected in a single platform the best psychometric assessments tools any employer needs to recruit, train, and develop the best work force. These tools can also be used by school to assess the career trajectory of a student and help students choose the right career path and career growth plan for them. These tools can also be used by Psychologists and Counsellors for purposes of assessing the emotional and psychological wellbeing of their clients.
Rezial Career Center is an online psychometric assessments center. The Rezial Career Center website and service including (without limitation) all websites, mobile applications, and other interactive properties through which the service is delivered (collectively, the “Service”) are owned, operated, and distributed by Rezial Career Center Limited, a Kenyan registered company (referred to in these Terms of Service as “Rezial” or “we” and through similar words such as “us,” “our,” etc.).
By accessing any part of the Service, you are agreeing to the terms and conditions described below (“these Terms of Use”), the terms and conditions of our privacy policy (the “Privacy Policy”) and any other legal notices published by us on the Service (collectively, the “Governing Documents”). If you do not agree to any of these terms, you should not use the Service. These Terms of Use apply to all users, including both users who are simply viewing content available via the Service and users who have created accounts on the platform, including the students and employees of such users.
We may, at our sole discretion, modify these Terms of Use at any time. By accessing the Service at any time after such modifications, you are agreeing to such modifications.
Rezial Career Center platform allows employers and schools to offer psychometric assessments tools to their employees and students. In the case of employers, the tools enable employers to identify, recruit, train, and develop employees and hence create a highly productive and skilled workforce aligned to the employers’ goals and vision. In the case of schools, the tools help schools and career advisers help students identify the careers and career pathways best suited to the student early in the training.
We reserve the right to refuse to provide the Service to any person for any reason and/or to discontinue the Service in whole or in part at any time, with or without prior notice.
These terms of use apply to your use of the Service and any account that you may open or attempt to open via the Service, including the use of the service by your employees or students:
In order to use our service, you will need to create an account on our platform. We may request the following documents in order to verify the indemnity of the contact person and/or the organisations:
On creation of an account for your organisation, a wallet will be opened on the platform for the purpose of funding the use of your account by your organisation and your employees or students. You must fund this account for you to be able to use the account and our service.
We charge a license fee of United States dollars five hundred dollars ($500) or local currency equivalent at prevailing bank exchange rates per year for the service. A sum equal to the license fee shall be automatically deducted from your wallet at the anniversary of your account creation.
The balance of the funds deposits into your wallet will be converted into credits for the purchase of the assessment tools for your employees or students your invite to take a test on the platform. The credits required for each test are dependent on a price set by Rezial in its exclusive jurisdiction and reserves the right to change the pricing from time to time. Your continued use of this platform after the price changes is approval of your consent to the price changes.
You may from time to time be required to deposit further funds into your wallet in order to access assessment tools for your employees or students. Your students or employees will not be able to access the assessment tools unless there are sufficient credits in your wallet to purchase the relevant assessment tools.
There are several third-party tools and services integrated in our platform to enable us to offer our services to you efficiently. These tools for example include payment gateways necessary to ensure payment are processed from you and credited to us. These tools are subject to terms and conditions, including privacy notices, controlled by those third-party providers and your us of them shall be subject to their respective terms and conditions.
At the creation of the account, your organisation provides details of an individual responsible for managing your account. Where there is a change in the administrator, for whatever reason, you shall notify us in writing and advise who the new administrator shall be. We shall, within two business days of such notification, update the details of the administrator to enable the new administrator to administer your account.
The entire contents of the Service are protected by copyright and trademark laws and other proprietary rights. The owners of the copyrights and trademarks are Rezial, its affiliates and/or other third-party licensors.
You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the material on the service, including text, graphics, code and/or software. You may print and download portions of material from the different areas of the Service solely for your own noncommercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials, and not to share any material that you paid for with anyone else who has not also purchased a license for that material.
You may not use any robots, spiders, or similar data mining, data gathering or extraction tools or manual processes to collect, gather or copy any content or data on or related to the Service in a manner not authorized by Rezial in writing. You may not engage in practices of “screen scraping,” “database scraping” or any other practice or activity the purpose of which is to obtain lists of users, portions of a database, or other lists or information from the Service, in any manner and any quantities not authorized by Rezial in writing. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout or form) of Rezial or its affiliates without express written consent. You may not use meta tags or any other “hidden text” utilizing the Rezial name or trademarks without the express written consent of Rezial.

If you believe that material or content residing on or accessible through the Service infringes your copyright (or the copyright of someone whom you are authorized to act on behalf of), please send a notice of copyright infringement containing the following information to Rezial at the address provided below:
Upon receipt of a proper notice of copyright infringement, we reserve the right to:
If the content provider believes that the material that was removed (or to which access was disabled) is not infringing, or the content provider believes that it has the right to post and use such material from the copyright owner, the copyright owner's agent, or, pursuant to the law, the content provider may send us a counter-notice containing the following information to the Designated Agent:
If a counter-notice is received by the Designated Agent, Rezial may, in its discretion, send a copy of the counter-notice to the original complaining party informing that person that Rezial may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider accused of committing infringement, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at Rezial’s discretion.

We may from time to suspend accounts which we believe upon reasonable grounds to be in breach of these terms of use. The grounds for suspension of accounts may include, but are not limited to the following:
Upon a request by us, you agree to defend, indemnify, and hold us and the other Rezial Parties harmless from all liabilities, claims, and expenses, including attorneys’ fees, that arise from your violation of these Terms of Use or any of the other Governing Documents, or other negligent or wrongful conduct. We reserve the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.
Notwithstanding any other provision in these Terms of Use, the liability of the parties will not be excluded or limited in any way in respect of the following:
The total liability of Rezial under or in connection with these Terms of Use and regardless of whether such liability arises in tort (including negligence), contract, breach of statutory duty or in any other way (including under any indemnity) shall not exceed the sum of United states dollars one thousand (USD 1,000).
Rezial is not liable for consequential, indirect, or special losses and will not accept liability for any of the following:
Any dispute arising under these terms of use will be dealt with in accordance with the provisions of this clause. The dispute resolution process may be initiated at any time by either party serving a notice in writing on the other party that a dispute has arisen. The notice shall include reasonable information as to the nature of the dispute.
The parties agree to use their best and all reasonable endeavours to reach a negotiated resolution through the following procedures:
The specific format for the resolution of the dispute under this clause shall be left to the reasonable discretion of the parties but may include the preparation and submission of statements of fact or of position.
If any such claim, dispute or issue cannot be settled by negotiation within 14 days of the first meeting of the chief executives (or persons designated) the Parties shall, before resorting to court or regulatory proceedings, attempt to resolve the claim, dispute or issue by Arbitration in accordance with the Arbitration Act of Kenya 1995 as amended from time to time by a single Arbitrator to be appointed by agreement between the parties or failing agreement within 14 days by the Chairman for the time being of the Chartered Institute of Arbitrators Kenya branch on application of either party.
Until the parties have completed the steps referred to in this clause and have failed to resolve the dispute, neither party shall commence formal legal proceedings or arbitration except that either party may at any time seek urgent interim relief from the courts or emergency arbitrator relief.
Any dispute or claim arising out of, or in connection with, your use of the service shall be governed by, and construed in accordance with, the laws of Kenya. You irrevocably agree that the courts of Kenya have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, these terms of use.
